Is Botticelli's Art Public Domain? Using His Images

Botticelli's original paintings are public domain, but scans, photographs and workshop attributions need separate checks before reuse or sale.

Yes—for Botticelli’s established, long-published works. The underlying art is public domain; a particular museum image, scan or restoration must still be checked.

Authorship matters. Works described as workshop of, follower of or after Botticelli should not be relabelled as autograph Botticelli paintings, even when the old image itself is public domain.

Can you use The Birth of Venus commercially?

The historical Birth of Venus is public domain under the ordinary copyright terms used in the European Union, United Kingdom and other life-plus-70 jurisdictions. Sandro Botticelli died in 1510, so his economic copyright expired centuries ago.

That answer does not automatically clear the first JPEG of The Birth of Venus found online. A modern photograph, scan, colour restoration or museum download is a separate file with its own provenance and possible terms. The old artwork and the supplied image must be checked independently.

The European and United States questions use different clocks

European Union and United Kingdom guidance generally measures an artistic work from the author’s death. Botticelli’s 1510 death places his established works far outside the ordinary life-plus-70 term.

United States law has additional rules for older published and unpublished works. Familiar paintings such as The Birth of Venus, Primavera and Venus and Mars have long reproduction histories, but GeMarkt still records each named object rather than assuming that every item inside a Botticelli folder has the same history. A newly discovered drawing or a work first made public much later deserves its own publication check.

Botticelli operated a workshop, and museums distinguish among “Botticelli,” “workshop of Botticelli,” “follower of Botticelli” and later copies. Those descriptions answer an authorship question. Public-domain status cannot turn a workshop object into an autograph Botticelli.

Our archive audit found a concrete example: a file titled The Last Communion of Saint Jerome corresponds to a museum record attributed to the workshop of Sandro Botticelli. It may still be an old public-domain work, but it should not be presented as a painting personally executed by Botticelli. It remains outside a Botticelli product or wallpaper release until the title, object type, attribution and source file are recorded correctly.

This is not a minor catalogue detail. Accurate attribution protects customer trust, improves search quality and prevents one incorrect filename from spreading into product titles, alt text and structured data.

What our 87 processed files do—and do not—prove

The GeMarkt archive has 87 processed Botticelli masters. Processing confirms that image work exists. It does not establish where every input file came from or whether the current museum attribution still matches an old filename.

Before publication, each master needs four independent states:

  • a stable object identity and current attribution;
  • an underlying-work copyright conclusion by jurisdiction;
  • a source-file record with a rights statement or open licence;
  • visual quality control for crop, colour, damage and output resolution.

If one state is missing, the file stays in review. This prevents a large folder from being mistaken for a large cleared catalogue.

Why this page uses The Adoration of the Magi

The feature image comes from the National Gallery of Art’s record for Botticelli’s The Adoration of the Magi, dated about 1478–82. The NGA identifies the object, provides downloadable media and maintains an open-access policy for public-domain images. The source and rights label remain visible in the caption instead of being hidden in our internal notes.

That model is stronger than starting with the most famous image. A famous work with a weak source trail is a worse production asset than a slightly less obvious work whose attribution, image and terms are documented together.

Other promising institutionally documented candidates include Portrait of a Youth and the NGA’s Botticelli devotional paintings. The Birth of Venus and Primavera remain high-value subjects, but their exact GeMarkt masters must be matched to source files whose reuse status is as clear as the historical artwork’s status.

A practical reuse checklist

Before using a Botticelli image in a product, article or wallpaper, record:

  1. The museum’s exact artist qualifier and object title.
  2. The object page and direct source-file URL.
  3. The rights label, licence and commercial-use position.
  4. The date those terms were reviewed.
  5. Whether the file is a faithful scan, a new photograph or a third-party edit.
  6. Any GeMarkt restoration and crop decisions.
  7. Duplicate, variant and misfile status.

For an established Botticelli work with an openly reusable source image, commercial printing and adaptation are generally possible under ordinary copyright rules. Local contract, moral-rights and cultural-property rules may still need consideration for a particular use.

Botticelli wallpapers will be released only from the source-cleared part of the archive. The free wallpaper library remains open without signup while that audit continues.

We checked the artist chronology against museum records, treated each named jurisdiction separately, and recorded the provider policy for the image set. These sources support the legal framework and artist dates used above; the source file for any individual image still needs its own record.
